Making a Will

Executors
You will need to appoint one or more persons to deal with matters after your death. This will ensure that all debts, funeral expenses and Inheritance Tax are paid and that your assets are then distributed in accordance with your Will. These people are known as your executors and should be people that you trust. You should have their agreement before appointing them to act in this capacity. It is possible to appoint your solicitor as your executor and we will be happy to act in that capacity.

Guardians
If you have infant children you and your spouse, partner or Civil Partner may wish to appoint guardians to care for your children should you both die before your children reach 18 years of age. This can be done in your Wills and you should ensure that the proposed guardians are happy to act in that capacity.

Gifts and beneficiaries
You can make cash gifts or leave specific items to specific people such as grandchildren and godchildren in your Will. You can also leave gifts to charities and other organisations.

Problems with a home-made Will
Many stationers offer packages to enable a Will to be made without professional legal advice. 'Home-made Wills' are not to be recommended. The English language is notoriously ambiguous. We have rarely seen a home-made Will which does not contain some ambiguity. Inheritance (or the prospect of inheritance) unfortunately brings out the worst in some people. Unless a Will is drafted in clear and specific terms, it is at risk of being successfully challenged by a disgruntled beneficiary. It is simply not worth taking this risk in order to save a few pounds on the cost of a professionally drafted Will. If a poorly drafted Will is challenged, the cost of dealing with any challenge can run to several thousands of pounds.
