Accidents At Work

If you have been injured in an accident at work then you may be entitled to bring a claim for compensation against your employer.

Employers are under a legal duty to provide employees with a safe system of work so that employees are not put at risk of injury during their employment.

For you to be able to pursue such a claim you will therefore need to show that the employer has failed to provide a safe system of work and has failed to take reasonable steps to prevent an accident from occurring.

Some examples of employers failing to safeguard employees' safety include:

Failing to provide adequate protective equipment
Failing to provide an adequate level of training and instruction for the use of machinery
Failing to assess the risks of loading and lifting heavy materials or equipment

An employee may also contract an industrial disease during their employment.

Employees are often reluctant to pursue claims against their employers for fear of jeopardising their employment. This is an understandable concern but employers run the risk of infringing an employee's rights if they act in such a way as to cause difficulties for an employee. This may give rise to a separate employment claim which we are also able to deal with on your behalf.

If you have suffered an accident at work then you should ensure that the accident has been recorded in the employer's Accident Report Book. Brief details of the accident, including the date and time it happened, should be recorded in the Accident Report Book either by yourself or somebody else in your presence.

There is often an overlap between accidents at work and other types of personal injury claim. For example, accidents at work often take the form of a slipping or tripping accident.
