Road Traffic Accidents

If you have been injured in a road traffic accident, you may be entitled to claim compensation. 

An injury can be both physical, such as a broken leg or a whiplash, or it can be psychological such as shock or anxiety.

We will advise you if you are able to make a claim and then take the appropriate steps to enable you to do so. You can make a claim if you were a:

Driver of a vehicle
Passenger in a private or commercial vehicle such as a bus
Pedestrian
A motorcycle or moped rider
Pedal cyclist
A horse rider

and you were involved in an accident that you believe was not your fault.

You may also be able to make a claim if you are a relative of someone who died in an accident that was not their fault. 

Claims can arise from accidents involving cars, buses, lorries, motorcycles and bicycles. Basically any vehicle.

Usually the Insurance company of the person who caused the accident will pay compensation to you. However, if you discover that the driver responsible for your accident does not have any insurance or the driver cannot be traced and remains unidentified, you can still make a claim for compensation. This is because compensation can be claimed from an organisation called the Motor Insurers Bureau ("MIB") which was set up specifically to deal with claims against untraced or uninsured drivers. We can help you make a claim to the MIB and guide you through the special procedures that apply. It is important to be aware of the requirements to give the MIB notice of procedural steps because failure to do so may mean the MIB will refuse to settle your claim.

If you have been involved in a road traffic accident and want to make a compensation claim, we would advise you to try to get the following details:-

Name and address of the person whose fault you believe it was;
  Their insurance details, including policy number and insurance company;
Their vehicle registration number;
Name and addresses of any witnesses who saw or have information about the accident;
Name of the Police officer who attended/investigated the accident and any correspondence from them.

It is also helpful if you can draw a sketch plan of what happened.
