Types of Compensation

You are entitled to be compensated for losses that you have already suffered because of the accident as well as the losses that you will suffer in the future.

Compensation is referred to as "damages". Damages can be divided into two categories; "General Damages" and "Special Damages".


General Damages - compensation for your injuries
General damages is the legal term used for the compensation that is paid for physical injuries, pain, suffering and loss of amenity. Injuries vary in each individual case. We act for clients with injuries ranging from minor whiplash injuries to fractures to severe spinal cord and head injuries. It is also possible to claim for psychological injuries (e.g. depression, Post Traumatic Stress Disorder).

As part of the investigations into your claim we will instruct a medical expert to examine you and produce a written report on your injuries. This evidence will be used to assess the value of your injury claim. The courts assess how serious the injury is, how it has affected your lifestyle, and whether there is any permanent disability, before deciding how much it is worth. The courts use previous cases involving similar injuries as guidelines for valuing compensation awards.

Special Damages - compensation for your financial losses
Special damages is the legal term used for the compensation that is paid for the financial losses and expenses caused by the accident.

These can be lost earnings, vehicle damage, medical treatment, etc. We recommend that from the very beginning you keep a careful record of your expenses and all documents required to prove your losses such as wage slips and receipts.

We will advise you on each and every aspect of your potential claim for financial losses including advise as to which items you can claim for and what proof is needed.
