Financial Provision
This is the single most important issue in all cases of family breakdown. Financial decisions or orders made by a Court dealing with finances, will invariably affect your future financial well being.
The provision to be considered may include the place where you will live, how you will meet the day-to-day living expenses for yourself and your children and money to call upon from time to time to cover unexpected expenses. It may also cover schooling and retirement provision.
Matrimonial breakdown is, perhaps, the one area of law that most people have had some contact with either from a personal involvement or from knowing others who have. These people, however well intentioned, are quick to offer advice which, more often than not, is incorrect.
Popular misconceptions include the following:-
 | Because the matrimonial home is in joint names it will be divided equally. Wrong! Whilst an equal division may be a starting point, depending upon the circumstances, one spouse may receive the entire property - for instance, where there are dependant children. |
 | Because the matrimonial home is in the sole name of one of the parties that that party will keep it. Wrong! The divorce county court has a wide discretion to make orders and may make orders transferring property irrespective of whose name it is in. |
